Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets forth the rules and guidelines for using the websites, web hosting, web development services, online courses, referral programs, and infrastructure provided by Fopik ("we," "our," or "us"), accessible via https://fopik.com. By utilizing any Fopik service, you agree to comply strictly with this policy.


1. Prohibited Content
 

You may not use Fopik’s servers, hosting infrastructure, or platforms to upload, host, transmit, link to, or distribute content that includes or promotes any of the following:

 
  • Illegal & Infringing Material: Sites must not contain pirated software (warez), illegal tools, or copyrighted content. The burden of proof rests entirely on the client to demonstrate legal ownership or rights to publish hosted material.
  • Adult & Explicit Material: Pornographic material, sexually explicit imagery, erotic content, or otherwise obscene material. Determination of what constitutes adult content is at the sole discretion of Fopik.
  • Harassment & Hate Speech: Content that promotes violence, hatred, discrimination, or defamation against individuals or groups.
  • Fraudulent Schemes: Phishing pages, counterfeit offerings, Ponzi schemes, or deceptive practices intended to defraud users.
 
2. Web Hosting & Resource Usage
 

To maintain optimal server performance, stability, and security across our infrastructure, hosting accounts are subject to the following resource and usage guidelines. Fopik reserves the right to disable or suspend any domain or account immediately upon becoming aware of a violation.

 
  • Primary Purpose of Hosting: The primary purpose of any account is to deliver web-based content to site visitors. All files uploaded to an account must be directly linked to active, publicly accessible web pages. Accounts may not be used for data archiving or file storage.
  •  
  • File Storage & Media Restrictions:
     
    • Archives & Backups: Accounts must not store password-protected archive files (e.g., .zip, .rar) or full system backups.
    • Audio & Streaming: Hosting standalone MP3 files is strictly prohibited as they do not constitute active web content. Other multimedia files are permitted only if configured to stream directly to visitors rather than serve as direct file downloads.
     
  • Scripting & Application Standards:
     
    • Scope: Scripts must be designed to display web pages. Simple scripts that trigger single automated emails upon user form input or update a database are permitted.
    • Forbidden Execution: Scripts that transmit bulk emails or perform CPU-intensive database operations are strictly prohibited. All outgoing email traffic is monitored and filtered.
    • Security Restrictions: Scripts attempting to access privileged server directories or bypass isolation boundaries to access other client accounts on the same server are strictly forbidden.
    • Timeouts & Cron Jobs: Scripts must not attempt to alter server execution timeouts. Cron jobs on Linux accounts must not run at intervals quicker than once every 5 minutes.
     
  • System & Resource Allocation:
     
    • Users agree not to consume excessive CPU processing power, memory, disk space, or bandwidth.
    • If a website monopolizes server resources or impacts neighboring clients, Fopik reserves the right to suspend the account immediately to safeguard the server environment. Where applicable, clients may be offered an upgraded hosting tier or additional resource allocation.
    • Account suspensions or corrective actions taken due to resource abuse do not entitle the client to a refund of prepaid fees.

  • Prohibited Gaming Services: Operating, hosting, or facilitating online gaming servers, gambling platforms, casino games, betting portals, or related gaming services is strictly prohibited on Fopik infrastructure under any circumstances.
 
3. Email & Anti-Spam Policy
 

Fopik maintains a strict zero-tolerance policy regarding Unsolicited Commercial Email (UCE), SPAM, and mail server abuse across our network.

 
  • Prohibited Email Practices: Email services provided by Fopik may not be used to:
     
    • Send unsolicited, abusive, offensive, indecent, or obscene messages.
    • Transmit communication intended to harass, inconvenience, or cause anxiety to internet users.
    • Engage in deceptive practices, phishing, fraudulent activities, or criminal offenses.
    • Promote websites hosted on Fopik using spam emails sent from external networks.
  •  
  • Mail Server Operational Issues: To maintain deliverability and prevent IP blacklisting, Fopik may remove offending mailboxes, adjust account settings, disable email features, or suspend a domain if mailboxes generate technical issues such as:
     
    • Receiving excessive volumes of undeliverable bounce emails.
    • Configuring email forwarders to invalid or non-existent recipient addresses.
    • Creating circular mail loops via misconfigured email forwarders or auto-responders.

  • Outbound Mail Blocking & SMTP Restrictions: Outbound SMTP traffic may be throttled or blocked immediately under the following conditions:
     
    • Detection of an open mail relay on the server or account.
    • Transmission of an abnormally high volume of emails within a 10-minute window.
    • Receipt of significant spam complaints or abuse reports from third-party networks or blacklists targeting a Fopik-hosted domain or IP address.

  • Spam Violations & Administrative Penalties:
     
    • Investigation: Upon receiving a spam complaint, Fopik will launch an investigation within 48 hours and may temporarily restrict network or mail access to prevent ongoing violations.
    • First Offense: Confirmed first-time spam violations will incur a $30 Administrative Fee, along with an immediate account review for potential termination.
    • Second Offense: A second spam violation will result in the immediate and permanent termination of the client account without refund eligibility.
    • Legal Action: Fopik reserves the right to seek civil remedies for costs associated with investigating policy breaches and will report criminal mail activities to law enforcement officials.

4. Prohibited System & Network Activities
 

To preserve network integrity and platform safety, the following actions are strictly prohibited on Fopik infrastructure:

 
  • Unsolicited Bulk Email (Spam): Sending unsolicited promotional emails, mass commercial messages, or operating open mail relays.
  • Cyberattacks & Network Abuse: Participating in Denial of Service (DoS/DDoS) attacks, network scanning, port probing, IP spoofing, or brute-force attempts against any system or network.
  • Unauthorized Access: Attempting to gain unauthorized access to administrative controls, user accounts, databases, or non-public server files.
  • Proxy & Bot Operations: Running unauthorized web crawlers, automated scraping bots, crypto-mining operations, open proxies, or public VPN services without prior written approval.
 
5. Service & Account Monitoring
 

Fopik reserves the right, but assumes no obligation, to monitor client traffic, server logs, hosted data, and user activity to ensure compliance with this AUP. We reserve the right to investigate potential violations, cooperate with legal authorities, and implement security controls to protect our network and users.

 
6. Enforcement & Consequences of Violation
 

If a user or hosting account is found to be in violation of this Acceptable Use Policy, Fopik reserves the right to take immediate enforcement actions at its sole discretion, including but not limited to:

 
  • Warnings: Issuing a formal warning or notice requiring immediate removal of violating content.
  • Content Suspension: Disabling or removing specific files, scripts, or databases causing the policy breach.
  • Account Termination: Immediately suspending or permanently terminating services, hosting access, or client accounts without prior notice.
  • No Refunds: Account terminations resulting from AUP violations forfeit any right to full or partial refunds, credit adjustments, or data retrieval.
 
7. Reporting AUP Violations
 

If you discover or suspect a violation of this Acceptable Use Policy hosted on or originating from Fopik's infrastructure, please submit a report with detailed evidence to contact@fopik.com.
