1. User Data Responsibility & No Automatic Backups

Fopik does NOT maintain or generate automatic server-side backups of client websites, databases, files, emails, or configurations unless specifically stated in a separate agreement.

• Client Responsibility: You are solely responsible for creating, downloading, and storing regular off-site backups of all your website files, databases, media assets, and account data.
• No Guarantee: Fopik does not guarantee that any data will be retained, recoverable, or preserved in the event of user error, site breakage, accidental deletion, or account suspension.

2. Optional Paid Backup Services

If you require automated, scheduled, or managed backup solutions for your website or server environment, you may purchase a dedicated Backup Add-on Service through your client area or by contacting our team.

• Scope of Paid Service: Paid backup services provide scheduled snapshots and restore options based on the specific plan purchased.
• Verification: Customers utilizing paid backup services are encouraged to regularly verify the integrity and completeness of their backups.

3. Limitation of Liability for Data Loss

To the maximum extent permitted by applicable law, Fopik, its owners, operators, and hosting infrastructure providers shall NOT be held liable or responsible under any circumstances for any data loss, data corruption, database failure, file deletion, or loss of business resulting from system failures, hardware breakdowns, network outages, cyberattacks, or technical errors.

In the event of hardware degradation, server failure, or emergency maintenance, Fopik will make reasonable efforts to restore server infrastructure, but we do not accept liability for unrecoverable client data.

4. Data Retention Upon Cancellation or Termination

Upon account cancellation, plan expiration, or termination due to non-payment or policy violation, all associated server data, files, and databases may be immediately and permanently deleted from our servers without recovery options or notice.
