3. Requirements for Filing a DMCA Takedown Notice

4. Notice Processing & Takedown Procedure

  2. User Notification: Promptly notify the affected content owner or user that access to their content or service has been disabled.
  3. Counter-Notice Opportunity: Provide the affected user with a copy of the infringement notice along with instructions on how to file a counter-notification.
 
5. Filing a DMCA Counter-Notification
 

If you believe your content, project, course submission, or hosted data was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated DMCA Agent at contact@fopik.com. The counter-notice must include:

 
  • Identification of Material: Specific URLs or details identifying the material that was removed or disabled and its prior location.
  • Consent to Jurisdiction: A statement consenting to applicable legal jurisdiction for dispute resolution.
  • Good Faith Penalty Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Contact Information: Your full legal name, address, phone number, and email address.
  • Physical or Electronic Signature: Your physical or electronic signature.
 

Upon receipt of a valid counter-notice, Fopik will forward a copy to the original complaining party. If the copyright holder does not file a court order or legal action within 10 to 14 business days, Fopik may restore the removed material or access at its sole discretion.

 
6. Repeat Infringer Policy
 

Fopik maintains a strict repeat infringer policy. We reserve the absolute right to suspend, disable, or permanently terminate the accounts and hosting access of users who repeatedly or egregiously infringe upon the intellectual property rights of others without prior refund or liability.

 
7. Limitation of Liability Disclaimer
 

Fopik acts as an online service provider and hosting intermediary. We shall not be held liable for copyright infringement claims arising from content uploaded, published, or transmitted independently by third-party users, clients, or members on our servers prior to receiving proper written notification under this policy.
